This Ag Data Use Policy (“Data Use Policy”) is a binding agreement between you and Combyne Ag, an unincorporated business division of Bayer CropScience Inc. By using the Combyne website (www.combyne.ag), the Combyne mobile applications, and other Combyne websites and services (collectively the “Services”), you agree to these terms. If you do not agree to these terms, do not use the Services.
This document establishes the terms by which your Data (defined below) is shared with Combyne and with third parties.
1. Data That Combyne Collects
Combyne collects only the data necessary to make the Services function properly, and only with your explicit consent. This primarily includes data that is relevant when you market agricultural crops.
1.1. Your Personal Information. When you use the Services, Combyne creates a unique identifier to enable Combyne to record your Ag Data (defined below), and associate such information with your account. This unique identifier is associated with your Personal Information, such as name, address, email, and phone number. Personal Information is defined in Combyne’s Privacy Policy, as well as how Combyne ensures your Personal Information is protected.
1.2. Ag Data. Combyne collects the following types of data, as defined by Ag Data Transparent (www.agdatatransparent.com), when you use the Services. Again, Combyne only collects data that is relevant when marketing agricultural crops.
1.2.1. Land Data. Includes data on specific practices used when producing crops, including tillage practice data, etc.
1.2.2. Agronomic Data. Includes data about the crop being sold, including grade and quality data, crop type, crop protection use, etc.
1.2.3. Farm Management Data. Includes business operations, supply chain, commodity prices, and transport and storage data. More specifically:
• Crop Inventory Data. Crop quantities, production year data, etc.
• Contract, Settlement, and Load Ticket Data. Contract terms including quantities, contracted price, buyer, delivered quantities and quality, final settlements, etc. as may be relevant in crop marketing management.
Collectively, this information is considered your “Data” in this policy. The categories of Data collected and used by Combyne may change as functionality of the Services changes, but Combyne’s commitment to obtain your consent prior to disclosure will not change.
2. Data Ownership and Disclosure
Combyne believes that you own your Data that originates from your use of the Services. Combyne believes that ownership gives you the right to share, download, and delete your Data. This also means that you have the right to determine how, when, and with whom your Data is disclosed through the Services. Combyne is a certified Ag Data Transparent (www.agdatatransparent.com) company.
Combyne assumes any person accessing your account has the right to share your Data through the Services. You release Combyne from any claims that someone else owns the Data uploaded to your account.
3. Sharing and Using Data
3.1. With Combyne
You grant Combyne a limited license to use your Data as provided in this paragraph. By using the Services, you give your consent to Combyne to share your Data among Combyne’s employees and agents to provide and improve the Services, for example, to provide customer support, or to customize the Services to your preferences such as providing prices for specific crop types.
“Anonymized and Aggregated Data” is Data that has Personal Information removed and is no longer identifiable to an individual account, combined with other anonymized Data and made available to other Registered Users. Combyne does not currently create nor utilize Anonymized and Aggregated Data.
Combyne will not share your Data with any person or company except as detailed above, unless you provide your consent. Should Combyne sell the Services to another company, you will be provided notice of the transaction and allowed to delete or remove your Data after the sale. All third party vendors used by Combyne to provide the Services that have access to your Data are required to abide by Combyne’s Privacy Policy, Terms of Use, and Data Use Policy.
3.2. With Others on Combyne
The Services provide you with the ability to share your Data with other registered Users of the Services, including Advisors as described in our Terms of Use. If an Advisor with whom you have a business relationship registers to the Services, you can optionally provide your consent to share your Data with the Advisor. Consent will be given directly to Combyne via your written approval, in response to a written request from the Combyne team. If you no longer wish to share your Data with an Advisor who you previously consented to data sharing with, please contact Combyne.
3.3. With Other Technology Providers
The Services provide you with the ability to share your Data with your other third party Technology Partners through links established through the Services and such third parties. Combyne will not share your Data with other Technology Partners without first obtaining your explicit consent, which may be given directly to Combyne or through your request to obtain your Data through one of Combyne’s integration partners. Consent is either provided when you initially link your Combyne account with any of your Technology Partner accounts, or when you initiate a specific Data sharing event between your Combyne account and an already-linked Technology Partner account. When you request your Data be transferred or shared with a technology partner, your use is subject to that third party’s policies and terms. Likewise, when you transfer or share Data from your third party technology partner with Combyne, any transferred or shared Data is subject to Combyne’s policies and terms.
4. Deleting Data
You may request that Combyne delete your account and your associated Data at any time by contacting Combyne using the contact information at the end of this document or by submitting a deletion request via the Combyne App.
Upon receiving your request to delete your account, Combyne will initially suspend your account for a period of 7 days. During this 7-day period, your Personal Information will remain stored on Combyne’s servers. During this 7-day period or at any point during your use of the Services, you may request a copy of your complete Data using the contact information at the end of this document.
After 7 days have passed, Combyne will permanently delete all of your Personal Information and Data from its servers, with the exception of instances where you have shared your Data with other registered users of the Services. In these instances, the process for requesting permanent deletion of all your Data is detailed in Section 9.3 of our Terms of Use.
5. Data Storage and Security
Once uploaded, Combyne stores your Data on servers that are owned or rented by Combyne from reliable services. Combyne takes reasonable and customary security measures to protect the privacy and security of your Data. In the event of a data breach, natural disaster, or other unforeseen event that causes your Data to be deleted or compromised, Combyne will notify you when you log in, by email, or other method required by law.
6. Your Obligations
You are responsible for submitting accurate Data to Combyne. If you discover that Data previously provided or uploaded to the Services is inaccurate, false, or misleading, you agree to delete or correct such information immediately or as soon as possible. You agree to defend and indemnify Combyne against all claims, losses, damages, and injuries arising from an intentional or negligent breach of your obligations in this Data Use Policy. If you allow third parties or other persons within your organization to upload Data into your account, you are responsible for ensuring the accuracy of such Data.
7. Modifications
Usage of Ag Data is rapidly evolving. Combyne may update this Date Use Policy from time to time to reflect changes in (a) the law, (b) the Services functionality, (c) Combyne’s agreements with other technology providers. No change in this Agreement shall occur without notice at the time you log into the Services or by email.
8. Limitations on Combyne’s Liability
Combyne is not liable for any damages that result from the disclosure of your Data to any person or company provided such disclosures are made according to this Data Use Policy. Further, Combyne is not responsible for a loss or unauthorized disclosure of your Data due to (i) an Act of God, (ii) other catastrophic event, or (iii) a data breach to the extent not caused by Combyne’s breach of this Data Use Policy. Combyne’s liability is further limited according to the Terms of Use.
